Terms and Conditions

These terms govern use of the ProofTrace website, public-source review interface, personal cabinet, API documentation, API endpoints, monitoring features and related public-facing communications.

1. Acceptance.

By accessing ProofTrace, creating an account, submitting a lookup, using the API, enabling monitoring or otherwise interacting with the service, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use ProofTrace.

If you use ProofTrace for an organization, you represent that you have authority to act for that organization or that you are otherwise allowed to perform the relevant evaluation.

2. Operator and commercial documents.

ProofTrace is operated by SToFU Systems S.L., Spain, unless another operator is stated in a signed customer agreement. Public website use is governed by these Terms. A signed NDA, order form, master services agreement, data processing agreement, statement of work or enterprise contract may add or replace terms for a specific engagement.

3. What ProofTrace provides.

ProofTrace helps users review public-source signals connected to an email address, username, nickname, phone number or similar identifier. Results may include status information, matched identifiers, public sources, summaries, confidence indicators, archives and monitoring updates.

ProofTrace does not guarantee that every public signal will be found, that every result is complete, that public information is accurate or that a human decision is safe merely because a trace has been run. Results are context, not an order to act.

4. Permitted use.

You may use ProofTrace only for lawful, proportionate and permitted public-source review, such as:

  • reviewing your own public footprint;
  • checking an unknown contact before replying, meeting, paying or sharing information;
  • reviewing a marketplace, community, partnership or business contact where you have a legitimate reason;
  • adding public-source review to a customer support, trust, safety, fraud-prevention or compliance workflow;
  • testing integrations that respect these Terms and applicable law.

Each lookup must have a permitted purpose. You remain responsible for the lawfulness of the identifier you submit and the action you take after reading results.

5. No regulated eligibility decisions.

ProofTrace is not a consumer reporting agency and does not provide consumer reports. You must not use ProofTrace for employment, tenant screening, credit, insurance, lending, benefits, education admission, licensing, background checks for regulated eligibility or any similar decision governed by the Fair Credit Reporting Act or comparable laws.

6. Prohibited conduct.

You must not:

  • use ProofTrace for stalking, harassment, intimidation, doxxing or unlawful surveillance;
  • submit identifiers without lawful authority, legitimate interest or required consent;
  • attempt to access private accounts, private messages, hidden systems or non-public data;
  • use results to make regulated eligibility decisions;
  • misrepresent your identity, purpose, authorization or organization;
  • circumvent rate limits, authentication, anti-abuse controls or security checks;
  • use bots, scraping, load generation or automation that disrupts the service;
  • submit malware, exploit payloads, credential dumps, secrets or unnecessary sensitive data;
  • resell, mirror, harvest or systematically extract ProofTrace content or output except under a written agreement;
  • use ProofTrace in violation of sanctions, export controls, privacy law, cybercrime law or court orders.

7. Accounts and credentials.

You are responsible for maintaining credential confidentiality and for activity under your account. Tell us promptly if you believe an account, password, API credential or session has been compromised.

We may restrict, suspend or terminate access if we believe an account is being misused, creating risk, violating these Terms or exposing the service or other people to harm.

8. API, integrations and monitoring.

API access is provided for approved workflows that respect the same permitted-use and privacy boundaries as the website. You must include required acknowledgements, keep credentials secure, use reasonable request volumes and design integrations so human operators can understand how ProofTrace results are being used.

Monitoring features may follow approved public-source signals over time. Monitoring is not permission to conduct invasive tracking, private account access, live location tracking or harassment. We may add, change, throttle or remove API and monitoring features where needed for reliability, security or legal compliance.

9. Data you submit.

You represent that you have the right to submit identifiers and related data to ProofTrace. You grant us the limited permission needed to process that data, run the requested review, provide results, secure the service, support your account and comply with law.

Do not submit confidential, regulated, export-controlled or highly sensitive material through public forms unless an appropriate secure process and written framework has been agreed.

10. Results and responsibility.

ProofTrace output may be incomplete, outdated, duplicated, ambiguous or affected by the quality of public sources. You must review context, avoid overreliance on a single signal and comply with all laws that apply to your use of the output.

You are responsible for decisions, communications, investigations, payments, meetings, escalations or integrations that rely on ProofTrace results.

11. Intellectual property.

ProofTrace, including its website, interface, design, text, code, documentation, API descriptions, branding, reports and original compilations, is owned by the operator or its licensors and is protected by applicable intellectual-property laws.

You receive a limited, revocable, non-exclusive, non-transferable right to use ProofTrace as allowed by these Terms. You may not copy, republish, frame, reverse engineer, modify, sell, sublicense, remove notices from or create competing datasets from ProofTrace materials except where law allows or a written agreement permits it.

12. Feedback.

If you send ideas, suggestions or feedback about ProofTrace, we may use them without compensation or restriction, provided we do not override a separate written agreement or misuse your protected confidential material.

13. Third-party services.

ProofTrace may link to or interact with third-party websites, public sources, search providers, infrastructure providers, payment providers, documentation tools or communication services. Those services are not controlled by us. Their own terms and privacy policies apply.

14. Availability, disclaimers and risk allocation.

ProofTrace is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not promise uninterrupted access, error-free operation, complete public-source coverage, exact identity resolution, suitability for your particular workflow or a specific outcome.

To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability and reliability.

15. Limitation of liability.

To the fullest extent permitted by law, ProofTrace, SToFU Systems S.L., affiliates, officers, employees, contractors and suppliers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profit, revenue, data, goodwill, business opportunity, anticipated savings or business interruption arising from your use of the service.

To the fullest extent permitted by law, total liability related to the public website and these Terms will not exceed the greater of EUR 100 or the amount you paid directly for the specific service feature giving rise to the claim during the twelve months before the event. Nothing limits liability that cannot lawfully be limited.

16. Indemnity.

You agree to defend, indemnify and hold harmless ProofTrace, SToFU Systems S.L., affiliates, officers, employees and contractors from claims, losses, damages, liabilities, costs and expenses arising from your misuse of ProofTrace, violation of these Terms, unlawful processing of identifiers, submitted data, breach of law or infringement of another person's rights.

17. Suspension and changes.

We may update, restrict, suspend, discontinue or change any part of the website, API, account features, monitoring or documentation at any time. We may block or limit traffic where needed to protect integrity, security, legal compliance or service quality.

We may update these Terms by posting a new version with a revised date. Continued use after an update means you accept the new version, where permitted by law.

18. Governing law and disputes.

These Terms and non-contractual obligations related to them are governed by the laws of Spain, excluding conflict-of-law rules. Unless mandatory law requires another venue, courts in Spain will have jurisdiction over disputes related to these Terms or the public service.

19. General terms.

If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, reorganization, sale, financing, restructuring or transfer of the relevant service.
